Our general terms and conditions
These general terms and conditions apply to all services, training courses and performances provided by Productiehuis 3Pees vzw/Inspiring Speech.
All information on the website of Productiehuis 3Pees vzw/Inspiring Speech may only be downloaded for informative private purposes. Any other use is prohibited.
By using the website or placing an order, you declare your agreement with the legal provisions. If you have any questions or comments, you can contact us using the contact details provided (see article 1).
The General Terms and Conditions of Productiehuis 3Pees vzw/Inspiring Speech are exclusively governed by Belgian law. In the event of a dispute, only the courts of Antwerp have jurisdiction.

Article 2 – Prices
Prices only refer to the article as described verbatim. All prices are exclusive of VAT. Additional obligatory delivery, reservation or other administrative costs will be stated separately for each article. Costs related to training are not included. Pick up of any orders to our office is free of charge.
The mentioned prices can be adjusted if it appears that incorrect prices are used during processing in the system. A placed order will never simply be increased and the customer will always receive a message that an error has occurred. This gives the customer the opportunity to accept the order or cancel it free of charge.
Article 3 – Offer
The range is intended for normal use by a “consumer”, as defined in the Market Practices Act of 6 April 2010. The offer is valid as long as stocks last and can be changed at any time. Promotions on articles are valid as long as they are posted on the webshop. Images are intended for illustrative purposes and may contain elements that are not included in the price or deviate from the article.
The offer, in whatever form, is always compiled with the greatest possible care.
Article 4 – Realisation of internet purchase
An order can only be placed via the Productiehuis 3Pees vzw/Inspiring Speech website.
An “Order” is the purchase of an article that is eligible for home delivery or collection at the office, or the registration for a course. Payment is made in advance. At that moment the purchase is made. The order will only be dispatched or prepared after receipt of payment.
The Seller reserves the right to refuse orders in the following cases:
– In case of serious suspicion of abuse of rights or bad faith on the part of the client
– When it can reasonably be assumed that the customer has the intention to resell the articles himself
– In the event of stock exhaustion or the unavailability of an item
– If an invalid offer is established
– In case of force majeure
Article 4.1 – Registration for training courses
A registration is final when the buyer has signed and returned the appropriate form. The buyer will receive confirmation of the registration within one week. Instructions for payment are included with the confirmation/invoice.
The Seller reserves the right to refuse registrations in the following cases:
-When the maximum number of participants for the training as mentioned on the info page has been reached.
-When the client is negligent in paying for the training course.
-When the training has to be rescheduled or cancelled due to force majeure.
Article 5 – Force majeure
Force majeure shall be understood to mean force majeure: All external causes, foreseen or unforeseen on which Productiehuis 3Pees vzw/Inspiring Speech cannot exercise any influence, but as a result of which Productiehuis 3Pees vzw/Inspiring Speech is unable to fulfil its obligations.
Production House 3Pees vzw/Inspiring Speech also has the right to invoke force majeure, if the circumstance preventing (further) fulfilment occurs after Production House 3Pees vzw/Inspiring Speech should have fulfilled its obligation.
During force majeure the delivery and other obligations of Productiehuis 3Pees vzw/Inspiring Speech will be suspended. If the period of time in which it is not possible for Productiehuis 3Pees vzw/Inspiring Speech to fulfil its obligations due to force majeure lasts longer than 8 weeks, both parties are entitled to dissolve the agreement, without any obligation to pay damages.
Article 6 – Payment
All training or performances must be paid for at the latest on the day of the start of the training. In case of payment of a training using KMO-portefeuille a proof of the start of the training shall be requested.

To ensure safe online payment and the security of your personal data, the transaction data is transmitted over the Internet encrypted with SSL technology. To pay with SSL you do not need any special software.
Article 7 – Delivery
Productiehuis 3Pees vzw/Inspiring Speech only delivers for online orders in Belgium and the Netherlands. Delivery times quoted by Productiehuis 3Pees vzw/Inspiring Speech are approximate and are not fatal. The deadline for delivery is 14 working days after receipt of payment. If a product, which is temporarily out of stock, is ordered by the customer, he will be informed when the product will be available again.
Delivery is made by post. Orders will be delivered to the address given up to the front door (ground floor). The risk of loss or damage shall pass to the customer when the goods are handed over. In case a re-offer is necessary because of the customer, the Productiehuis 3Pees vzw/Inspiring Speech reserves the right to charge the customer for the costs caused by this.
The delivery or shipping costs will be communicated to you before confirming the purchase.
For live performances, shows or training, a mileage or accommodation fee will be charged.
Article 8 – Defects/Warranty
The customer should take delivery of the goods immediately and inspect them carefully. In the event of complaints about the goods or services, the customer must report these complaints in writing within 7 days, as well as return the goods together with the accompanying dispatch note. For the address to which these complaints and goods must be addressed, see Article 1. Lodging a complaint does not release the buyer from his payment obligations.
For consumers, the legal guarantee of 2 years applies. This guarantee only covers a lack of conformity that already exists at the time of delivery of the goods. During the aforementioned period, Productiehuis 3Pees vzw/Inspiring Speech undertakes to replace or repair the defective article (or part) free of charge. The Seller reserves the right to exchange the article if the costs are disproportionate, or if repair is impossible.
Defects which manifest themselves after a period of 6 months after delivery will not be deemed to be present at the time of delivery, unless proven otherwise by the Client.
The guarantee never applies to defects caused by accidents, aggravation of the condition by negligence, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the appliance, heavy-handed use, incorrect assembly, poor maintenance, abnormal, commercial or incorrect use.
Nor does it apply to articles with a shorter lifespan (e.g. batteries, wear and tear articles or articles with a shorter expiry date) or in the event of intervention by a third party not designated by Productiehuis 3Pees vzw/Inspiring Speech.
Article 9 – Right of renunciation
This provision only applies to Internet sales to consumers:
In accordance with the law of 6 April 2010, the customer has the right to notify Productionhuis 3Pees vzw/Inspiring Speech that he renounces the purchase, without payment of a penalty and without giving a reason, within 14 days from the day following the delivery of the product. This period must allow the customer to evaluate the purchased product “as in a shop window”.
Opened packaging, used goods, or incomplete/damaged products or packaging will not be taken back.
The customer who wishes to make use of this right, must contact the Production House 3Pees vzw/Inspiring Speech within 14 days via email info@driepees.be.
In addition, he must return the appliances within the same period of time in their original, undamaged and undamaged packaging, together with all accessories, the instructions for use and (a copy of) the invoice/delivery note:
– return the product at his own expense and under his responsibility to Productiehuis 3Pees vzw/Inspiring Speech (see article 1);
– or have the product collected by Productiehuis 3Pees vzw/Inspiring Speech, subject to payment of an intervention in the transport costs.
Productionhuis 3Pees vzw/Inspiring Speech will refund the sums paid within 30 days after acceptance of the take-back, with the exception of the costs of delivery.
Article 9.1 Cancellation of participation in training courses.
More than one month before the start
Does the buyer know more than one month before the start of the training that participation is impossible? Please let us know in writing as soon as possible.
There are two possibilities:
-Buyer has himself replaced by someone else
-Buyer pays 50% of the price of the training as compensation
Less than one month before the start
If the buyer knows less than one month before the start of the training that participation is impossible, the full amount will remain due anyway. Of course, the buyer may also have himself replaced by someone else; this is always allowed.
Article 10 – Proof
The customer accepts that electronic communications and backups may serve as evidence.
Article 11 – Intellectual property rights
The contents of this site, including brands, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to Productiehuis 3Pees vzw/Inspiring Speech or entitled third parties.
Article 12 – Limitation of liability
Production house 3Pees vzw/Inspiring Speech cannot be held liable for damages such as loss of profit, cancellation or interruption of operations or loss of data.
Production house 3Pees vzw/Inspiring Speech cannot be held liable for accidents during training sessions or on the route to and from the location where a training course is given. The buyer is assumed to have insurance for this.
Article 12.1 – Availability of website
Production house 3Pees vzw/Inspiring Speech explicitly rejects any liability for the continuous availability of the website. In addition, Productiehuis 3Pees vzw/Inspiring Speech has the right to discontinue the operation and/or maintenance of this website in whole or in part at any time or to restrict access to the site without prior notice.
Article 12.2 – Use of the website, its content and the information offered
The information published by Productiehuis 3Pees vzw/Inspiring Speech is free of charge, unless otherwise stated. Each user may use and document the information provided for private purposes. Any other use of the information, in particular any form of reproduction, modification or integration in publications or advertisements, is only permitted after approval by Productiehuis 3Pees vzw/Inspiring Speech or the rightful owner of the information.
Productiehuis 3Pees vzw/Inspiring Speech emphasises that protective rights may apply to the content and the information; these protective rights (in particular name and trademark) always remain the property of Productiehuis 3Pees vzw/Inspiring Speech. All information has been carefully collected and checked by Productiehuis 3Pees vzw/Inspiring Speech and subsequently published at its own discretion. The information of third parties has been taken over unchanged. The users themselves must check whether the information provided is correct, complete and/or up-to-date.
The liability of Productiehuis 3Pees vzw/Inspiring Speech for damages as a result of incorrect, incomplete or outdated information and also for damages as a result of a misinterpretation of the information provided by the user, is limited to gross negligence or intentional conduct on the part of Productiehuis 3Pees vzw/Inspiring Speech. In addition, Productiehuis 3Pees vzw/Inspiring Speech cannot be held liable for damages resulting from incorrect use of the information provided by the user.
Article 12.3 – Links/content and information of third parties
The website may contain hyperlinks and references to web pages of third parties. Production house 3Pees vzw/Inspiring Speech is not liable for the content of these web pages. Production house 3Pees vzw/Inspiring Speech cannot be held liable for the quality, accuracy or completeness of the information provided by third parties.
Article 12.4 – Rules for the use of passwords and accountability
The user himself is responsible for the security of his password and must avoid any misuse of the password he has received for use of the website. If the user discovers that his password has been unintentionally passed on to unauthorised persons and/or third parties or that his password may be misused, he must immediately inform Productionhuis 3Pees vzw/Inspiring Speech.
Notwithstanding the foregoing, Productiehuis 3Pees vzw/Inspiring Speech cannot be held liable, either contractually, legally or according to legal theories that could be considered applicable, for damages resulting from any misuse of personal passwords, except when such misuse is the result of intentional behaviour or gross negligence on the part of a Production House 3Pees vzw/Inspiring Speech employee or a third party working for Productiehuis 3Pees vzw/Inspiring Speech.

Article 12.5 – Important message related to computer viruses
Production house 3Pees vzw/Inspiring Speech makes every effort to protect the website from viruses. Production house 3Pees vzw/Inspiring Speech cannot guarantee that its site is also virus free. The user must, in his own interest, take the necessary security measures and scan all information, software or documentation for viruses before downloading it.
